Terms of Service

1. Who we are and what this covers
KardX provides a digital account that holds a balance in USDC, a dollar-denominated stablecoin, and lets you send, receive, spend and invoice against that balance. These terms apply to your use of the KardX website, mobile apps and API.
By opening an account or using the service you agree to these terms. If you do not agree, do not use the service.
2. KardX is not a bank
Your balance is not a bank deposit. It is not insured by any deposit guarantee scheme, and we do not pay interest on it. KardX is not a bank and does not offer banking services.
Your balance is denominated in USDC and held with a regulated custody partner. USDC is intended to hold a value of one US dollar, but that is maintained by its issuer and not guaranteed by us. If USDC loses its value against the dollar, your balance loses value with it.
3. Opening an account
- You must be at least 18 years old and legally able to enter a contract.
- You must give accurate information and keep it up to date.
- Access is currently by invitation. We may decline an application without giving a reason.
- One account per person. Accounts are personal to you and may not be transferred or shared.
Before you can move money we are required to verify your identity. Until verification is complete, some features are unavailable to you. We may ask for further information at any time and may restrict the account until we receive it.
4. Your balance and how it moves
Every movement of money on your account is recorded on a double-entry ledger. Your balance is the sum of those records — we do not keep a separate balance figure that could disagree with them.
- Adding funds by card: the money reaches your balance once our payment provider confirms the payment has settled, not when you press pay.
- Sending to another KardX account: instant, and free.
- On-chain transfers: subject to network confirmation times outside our control. A transfer sent to the wrong network or the wrong asset cannot be recovered.
- Payouts to a bank account: subject to the receiving bank and the local payment system.
Some features described on our website are not yet available. The app shows the current status of each one. We do not charge for a feature that is not switched on.
5. Fees and exchange rates
Fees are shown before you confirm any transaction. You will not be charged a fee you have not been shown.
Where a transaction involves converting between currencies, the rate is fixed at the moment you confirm and is shown to you at that point. The rate includes our margin; there is no separate hidden spread.
We may change our fees. Changes take effect no sooner than 30 days after we tell you, except where a change is in your favour.
6. Things you must not do
- Break any law, or use the account for money laundering, terrorist financing, or sanctions evasion.
- Use the account on behalf of someone else without telling us.
- Give false information, or use documents that are not yours.
- Attempt to gain access to accounts, systems or data that are not yours.
- Use the service in a country we do not serve, or where the service would be unlawful.
7. When we can restrict or close an account
We may suspend some or all of an account's functions, or close it, where we reasonably believe it is necessary — for example if we suspect fraud or unlawful use, if we are required to by law, or if you break these terms.
Where an account is restricted, we will tell you the reason unless the law prevents us. You keep your right to your balance, and we will return it to you subject to any legal obligation preventing us from doing so.
You may close your account at any time by writing to us.
8. Keeping your account safe
Keep your sign-in details and your device secure. Tell us immediately if you think someone else has access to your account. Where you have enabled it, we will ask for your fingerprint or face before opening the app.
We will never ask you for your password, a one-time code, or a private key. Anyone who does is not us.
9. If something goes wrong
Tell us as soon as you can, through the support conversation in the app. We will investigate and tell you what we find.
Where a payment fails after your balance has been reduced, the full amount including any fee is returned to your balance.
We are responsible for loss we cause by failing to take reasonable care. We are not responsible for loss caused by something outside our reasonable control, by you giving us wrong details, or by an on-chain transfer you sent to the wrong address or network. Nothing in these terms limits liability that cannot lawfully be limited.
10. Changes to these terms
We may change these terms. We will tell you before a change takes effect and you may close your account if you do not accept it. The date at the top of this page shows when it last changed.
